Tritonal is currently booked to perform at Marquee Nightclub in Las Vegas June 7th and 15th, July 20th and 25th, and September 28th. Additional performance dates, accommodations and travel arrangements to be determined by Sponsor.
Eligibility
This contest is open to all adults, 18 and over. Employees, volunteers and currently enrolled students of C89.5 / KNHC Public Radio (“KNHC”) or Seattle Public Schools, the Sweepstake’s participating sponsors (“Sponsors”) and their advertising agencies, and members of the immediate family of any such persons are not eligible to participate and win.
Compliance with the eligibility requirements will be determined solely by KNHC. All Federal, State and local laws and regulations apply. Void wherever prohibited or restricted by law.
Entries
The Sweepstakes begins at 12:00 a.m. (PDT) on Wednesday, April 3rd, 2019 and ends at 11:59 p.m. (PDT) on Friday, April 26th, 2019 (“Sweepstakes Period”). Any eligible individual who contributes $60 or more to KNHC during the Sweepstakes Period, or who initiates a recurring contribution of $5 or more per month payable for at least 12 months or who is currently contributing $5 or more per month will automatically be entered in the Sweepstakes.
In compliance with the Washington State Gambling Commission regulations, a donation to KNHC is not required to enter the sweepstakes. One-time entries will be accepted online through our Contact form here during the Sweepstakes Period or by leaving a voice message at 206-252-3817. Sweepstakes entrants must provide their legal name, email address, valid phone number and mailing address, and indicate they are entering the “Tritonal Sweepstakes.”
Regardless of method of entry, only one (1) entry per person is allowed. Any person submitting multiple entries will be disqualified from the drawing. All entries become the property of KNHC and will not be acknowledged or returned.
KNHC assumes no responsibility for computer system, hardware, software or program malfunctions or other errors, failures, damages, delayed computer transactions or network connections, whether human, technical or otherwise in nature, in conjunction with this contest, participation or in connection with any prize acceptance. KNHC, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the website or who is otherwise in violation of the Official Rules. Entrants agree KNHC has the sole right to decide all matters and disputes arising from this contest and that its decision is final and binding.
Determination and Awarding of Prizes
Winner will be determined in a random drawing (from among all eligible entries) on or about April 29th, 2019, conducted by representatives of KNHC, whose decisions are final and binding in all matters relating to this Sweepstakes. Winner will be notified by telephone or e-mail on or about May 1st, 2019 and will be given instructions on how to claim their prize. Any prize not accepted by the winner within 5 days of notification, in KNHC’s sole discretion, will be awarded to an alternate winner. If a prize notification e-mail or any prize is returned to KNHC or its designated agent as undeliverable, that prize will be awarded to an alternate winner.
Prizes
One (1) prize winner will receive two (2) round-trip airline tickets from Seattle, WA to Las Vegas, Nevada, one (1) hotel room for two (2) persons, and two (2) complimentary tickets to a performance by Tritonal (band) in Las Vegas, Nevada. The prize may include a mix of physical tickets, vouchers representing tickets held at will call, or guests list spots to be claimed at will-call. Choice of airline and hotel and performance venue are at the sole discretion of the Sponsor.
Complimentary performance admission is subject to the rules, policies and procedures of the Sponsor. A photo I.D. may be required to gain admission to the event. Seating arrangements, if applicable, are determined by the Sponsor.
To obtain the Prize, the winning entrant must provide proof of the correctness of entrant’s information on the entry form and compliance with the terms and conditions contained in the Official Rules by signing an Affidavit of Eligibility, and release of publicity and release of liability and must provide KNHC with their taxpayer identification number using the appropriate form (currently Form W-9) obtainable on the IRS website: https://www.irs.gov/forms-pubs/about-form-w-9 and return the executed documents to KNHC no later than May 30th, 2019.
All taxes on prizes, including but not limited to Federal, State and local income and sales taxes, are the responsibility of the winner.
Value is based on the Fair Market value, which is defined in IRS Publication 561, available at irs.gov.
No cash equivalent will be made for a prize. Prizes are not redeemable for cash, exchangeable, or transferable.
KNHC and Sponsor reserve the right to substitute a prize of equal or greater value if the awarded prize is unavailable for any reason.
Odds of Winning
Odds of winning are determined by the total number of entries received.
Release and Indemnification
KNHC is not responsible for any cancellation or rescheduling of the performance for any reason and has no obligation to reimburse, refund, or otherwise substitute the tickets for another prize should the performance not be rescheduled, or vouchers not issued. Furthermore, KNHC is not responsible for cancellations or delays in travel or hotel accommodations and has no obligation to reimburse, refund, or otherwise substitute any tickets awarded as a part of a travel or hotel prize due to such cancellations or delays.
Entry constitutes permission for KNHC (except where prohibited by law) to use winner’s name, area of residence, voice, picture and/or likeness for publicity purposes without additional compensation.
By entering, all entrants agree to be bound by the Official Rules and further agree to release, indemnify, and hold harmless KNHC, its licensee, affiliates, successors and funders, and their respective directors, officers and employees from and against all actions, causes of actions and liability, including attorney’s fees and costs, arising out of or relating to participation in the contest and receipt and use or misuse of the prize awarded.
Additional Rules
Entry materials/data that have been tampered with or altered, or mass entries generated by a script, macro, or use of automated devices are void. KNHC and the Sponsor are not responsible for; (i) lost, late, misdirected, damaged, garbled, or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations of transmission, theft, or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by KNHC on account of technical problems or traffic congestion on the internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any person’s computer related to or resulting from participating in the Sweepstakes.
KNHC reserves the right to: (i) permanently disqualify from any Sweepstakes any person it believes has intentionally violated these official rules; and (ii) suspend, modify, or terminate the Sweepstakes if KNHC believes, in its sole discretion, that malfunction, error, disruption, or damage is impairing or will impair the administration, security, fairness, or integrity or proper play of the Sweepstakes. If Sweepstakes is terminated before the end date, KNHC will determine the winner from all eligible entries received as of the termination date.
These Rules and this Sweepstakes are governed by and controlled by the laws of the State of Washington, applicable to contracts made and performed therein without reference to the applicable choice of law provisions.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER, OR VANDALIZE THIS WEB SITE, OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND KNHC RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
